Patent Registration

There are multiple benefits of protecting your inventions. One of them and among the most important is the fact that no one else can commercialize the sale of your invention without your consent. You can also publish your invention safely and without the risk that third parties may illegally replicate it and profit from it.

Registering your patent is essential because it protects the invention for a period of 10 to 20 years depending on the type of invention and its registration. During this time, you have complete control over your inventions and the rights attached to them.

By having your registration certificate, you have control over all of your patent rights. When you want to commercialize the sale of your invention, you can negotiate the terms with any company or person without affecting your rights.

This process has several steps that can be summarized as:

  1. Presentation
  2. Examination of form and substance
  3. Request for a report on the state of the art
  4. Publication
  5. Issuance of the registration certificate

Requirements for patent registration:

In order to begin the registration process, the following requirements must be met:

  1. Detailed description of your invention, industrial design or utility model.

The first step in registering your patent is to write a detailed document explaining how your invention works. You can schedule a free consultation with us and we'll explain how this description works.

  1. Statement of claims:

Tell us what are the characteristics that make your invention unique. Create a list of these characteristics so that they can be reviewed by examiners and protected through patent registration.

  1. Drawings:

The documentation you are going to provide us needs to be illustrated by means of drawings. This means that the official who is going to examine your documents must have an idea of what your invention looks like, as it looks. You can do the drawings yourself or you can ask a designer to help you.

  1. Summary:

Briefly explain (no more than 10 lines) the most fundamental aspects of your invention and how it works. This summary will be mentioned on your registration certificate so that those interested can understand what your invention is about in a summarized and simple way.

Patent Renewal

Protect your patents for 10 to 20 years!

Your patents are protected for a period of 10 to 20 years and must be renewed every 5 years until the mentioned total is reached. This prevents you from losing your registration and allowing third parties to appropriate your invention. After this time, the invention becomes in the public domain and can be legally replicated.

The renewal process can be described as follows:

  • Submission of a renewal request
  • Application Examination
  • Issuance of resolved renewal for 5 years
  • Etc.

The renewal process can take 6 to 8 months.

Renewal process requirements:

If this is your first time with us, it is important that you sign a POA, which we write, (if you come from abroad it must be apostilled) so that we can help you with the renewal. If you already have a power of attorney with us, it is not necessary to sign a new one.

Patent surveillance

Stay informed about possible registration requests that affect your patent.

We take care to ensure that your patents are not affected by third-party registrations and we act quickly in the event of an infringement against you. We monitor the monthly publications of the intellectual property newsletter and ensure that third parties do not attempt to register patents identical to yours.

You can stay informed about patent applications that affect your registration because they are similar or identical. This allows you to act quickly to resolve the problem through negotiations or judicial processes.

Our surveillance system notifies us of requests to register patents, utility models, industrial design, etc. to search for possible solutions hand in hand with our customers.

The process is relatively simple, our system allows us to analyze each bulletin issued by the DIGERPI (General Directorate of Industrial Property) to compare possible results of registration requests that share similarities with our clients' patents.

Modification of patents

The modification of your patent registration can be during the registration process or after the registration process (when you obtain your certificate). In the case of a modification of the registration as such, it is important to do so before publication in the DIGERPI bulletin. Any other changes, additions of documents or others can be made once your patent has been granted.

If your patent has a significant change, for example, if you transfer the rights, if you make any modifications, it is important to inform the competent authority. This allows any contract, agreement, modification, addition or other to be registered in the DIGERPI and considered valid at the national level.

This helps you enter into contracts and allow the use of your patent with other companies in a transparent manner.

The process works as follows:

  • Submission an application form together with the changes made.
  • Examination
  • Issuance of resolved certifying the changes made.

If you want to transfer the rights to your patent, change the name, or modify something about the invention, we can help you without any problem!
